Terms of Service
Effective date: September 9, 2026
1. Agreement to These Terms
Welcome to nextselph.org. These Terms of Service ("Terms") are an agreement between you and NextSelph, Inc. ("NextSelph," "we," "us," or "our") governing your access to and use of nextselph.org and the related features and services we make available through it (collectively, the "Site"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
Our Privacy Policy describes how we collect, use, disclose, retain, and protect personal information in connection with the Site and is incorporated into these Terms by reference.
2. About NextSelph.org
NextSelph.org is an AI-powered promotional website for the future release of the NextSelph consumer health application. The Site allows eligible users to create an account, join a waitlist for early access, and preview NextSelph's AI photo experience. A user may upload a photograph of themselves, which NextSelph processes using artificial intelligence to generate an illustrative image of that user at an older age (a "Selph"). Eligible users may also choose to participate with another consenting user in a private "Future Selves" photo reel.
The current Site is a promotional and preview experience. It is not the full NextSelph application and does not provide medical care or medical services.
3. Eligibility and Accounts
You must be at least 18 years old to use the Site. You may not create an account, upload a photograph, generate a Selph, or participate in a Future Selves reel if you are under 18.
You may upload only a photograph depicting yourself. You may not upload a photograph depicting another person, including a minor, even if you have that person's permission.
The Site uses your email address to create and authenticate your account. You are responsible for maintaining control of the email account you use to access NextSelph and for activity occurring through your NextSelph account. You may not allow another person to use your account or attempt to access another user's account.
We may refuse, suspend, or terminate access to the Site if we reasonably believe you do not meet these requirements or have violated these Terms.
4. Artificial Intelligence and Generated Content
The Site uses artificial intelligence and automated technologies to process photographs and generate Selphs and related content ("AI-Generated Content"). AI-Generated Content is created automatically and may be inaccurate, unexpected, unrealistic, incomplete, or otherwise different from actual outcomes.
A Selph or other AI-Generated Content is an illustrative and artistic rendering. It is not a prediction or representation of how you will actually look, age, feel, or experience future health outcomes.
5. No Medical Advice; Health Disclaimer
The Site and all AI-Generated Content are provided for informational, illustrative, and promotional purposes only. They are not medical advice and are not intended to diagnose, treat, cure, prevent, or predict any disease, condition, health outcome, life expectancy, or other medical result.
A Selph does not reflect your actual health status or risk of any condition. NextSelph is not a healthcare provider, and no physician-patient, provider-patient, or other clinical relationship is created by your use of the Site. Always seek the advice of a qualified healthcare professional regarding medical questions or decisions, and do not disregard or delay professional medical advice because of anything shown or generated through the Site.
6. Your Photograph
You may submit only a photograph of yourself that you own or otherwise have the legal right to use and submit. Your photograph must not infringe or violate any copyright, privacy right, publicity right, contract right, or other right of any person or entity, and must not be unlawful, defamatory, obscene, harassing, or otherwise prohibited by these Terms or applicable law.
As between you and NextSelph, you retain any rights you have in the photograph you submit. You grant NextSelph a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify, and process your photograph solely as reasonably necessary to operate and provide the Site, including to generate your Selph and any Future Selves reel in which you choose to participate, and as otherwise described in our Privacy Policy.
NextSelph does not use submitted photographs or generated Selphs to train, fine-tune, evaluate, test, or improve its image-processing models.
We may reject or remove a photograph or generated image that violates these Terms or applicable law.
7. Future Selves
A Future Selves reel may be created only between eligible NextSelph users who have each affirmatively agreed to participate. Each participant uploads and controls their own photograph and account. Future Selves reels are private and are made available only to the participating users.
If either participant deletes their NextSelph account, any Future Selves reel containing that participant will be removed from the active service as described in our Privacy Policy.
8. Your Use of AI-Generated Content
Subject to these Terms and any rights of third parties, you may download, save, and share your Selph or a Future Selves reel in which you participate for your personal, non-commercial use. You are responsible for how you choose to use or share AI-Generated Content outside the Site.
Nothing in these Terms grants you rights to NextSelph's software, models, technology, trademarks, branding, or other proprietary materials incorporated into or used to provide the Site.
9. Account Deletion
You may delete your account at any time using the account deletion functionality made available through the Site. Account deletion removes your account from the active service, including your submitted photograph, generated Selph, and any Future Selves reels containing you. If you later sign up again, you will be treated as a new user and will need to create a new account and repeat onboarding.
Residual copies may remain for a limited period in routine backups or where retention is reasonably necessary for security, fraud prevention, dispute resolution, or legal compliance. Additional details are provided in our Privacy Policy.
10. Acceptable Use
You agree not to misuse the Site. You may not:
- use the Site for any unlawful, fraudulent, deceptive, abusive, or harmful purpose;
- upload a photograph of anyone other than yourself or submit content you do not have the right to use;
- attempt to gain unauthorized access to another account, private media, systems, networks, or data;
- interfere with, disable, disrupt, overburden, or circumvent security, access, usage, or rate controls of the Site;
- use automated means to scrape, harvest, probe, or access the Site except as expressly authorized by NextSelph;
- reverse engineer, decompile, or attempt to derive source code, models, or non-public technology except where applicable law expressly permits it; or
- use the Site or AI-Generated Content in a manner that infringes or violates another person's rights.
11. NextSelph Intellectual Property
Except for content submitted by users and third-party materials, the Site and its software, design, text, graphics, logos, trademarks, technology, and other content are owned by NextSelph or its licensors and are protected by applicable intellectual property laws. Subject to these Terms, NextSelph grants you a limited, personal, non-exclusive, non-transferable, revocable right to access and use the Site for its intended purpose.
No other license or right is granted except as expressly stated in these Terms.
12. Third-Party Services and Links
NextSelph may use third-party service providers to host, transmit, secure, communicate through, or otherwise support portions of the Site. Our use and disclosure of personal information in connection with these providers is described in our Privacy Policy.
The Site may also contain links to websites or services operated by third parties. NextSelph does not control and is not responsible for third-party websites, services, content, or privacy practices. Your use of third-party services may be subject to separate terms and policies.
13. Electronic Communications
When you use the Site or communicate with NextSelph electronically, you consent to receive communications from us electronically, including by email and through the Site. You agree that electronic notices, disclosures, and other communications satisfy any legal requirement that such communications be in writing, to the extent permitted by law.
14. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT, FEATURES, AI-GENERATED CONTENT, AND SERVICES MADE AVAILABLE THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXTSELPH DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.
NEXTSELPH DOES NOT WARRANT THAT ANY SELPH, FUTURE SELVES REEL, VISUALIZATION, OR OTHER AI-GENERATED CONTENT WILL BE ACCURATE, LIFELIKE, PREDICTIVE, OR SUITABLE FOR ANY HEALTH, MEDICAL, DIAGNOSTIC, OR OTHER PURPOSE.
Some jurisdictions do not allow certain warranty exclusions, so some of the above exclusions may not apply to you.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXTSELPH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR USE, ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IF YOU ARE DISSATISFIED WITH THE SITE OR THESE TERMS, YOUR REMEDY IS TO STOP USING THE SITE. Nothing in these Terms limits liability or rights that cannot lawfully be limited or waived.
16. Indemnification
To the extent permitted by law, you agree to indemnify, defend, and hold harmless NextSelph and its officers, directors, employees, agents, affiliates, licensors, and service providers from claims, liabilities, damages, losses, and reasonable costs and expenses (including reasonable attorneys' fees) arising out of or relating to your misuse of the Site, your violation of these Terms or applicable law, or your photograph or content that you submit infringes or violates the intellectual property rights of another person or entity. NextSelph may assume control of the defense of any matter subject to indemnification, in which case you agree to reasonably cooperate with us.
17. Arbitration
Except for matters that may be brought in small claims court and requests for temporary or preliminary injunctive relief to protect intellectual property or preserve the status quo pending arbitration, any dispute arising out of or relating to these Terms or the Site that cannot be resolved informally will be resolved by final and binding arbitration under the Federal Arbitration Act before a single neutral arbitrator administered by the American Arbitration Association (AAA), or another arbitration provider agreed to by the parties. The arbitration will take place in San Francisco, California or by remote means where permitted by the applicable rules. The arbitrator will have exclusive authority to determine any dispute, however, the state or federal courts located in San Francisco will have authority to determine any dispute about enforceability or requests for injunctive relief.
The arbitrator will have authority to resolve disputes concerning the interpretation, applicability, enforceability, or formation of this arbitration provision. Judgment on the award may be entered in any court having jurisdiction. This section survives termination of these Terms.
18. Class Action Waiver
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND NEXTSELPH AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. Unless you and NextSelph agree otherwise, the arbitrator may not consolidate more than one person's claims or preside over any form of representative or class proceeding.
19. Termination
You may stop using the Site at any time. NextSelph may suspend or terminate your access to all or part of the Site if we reasonably believe you have violated these Terms, created risk or legal exposure for NextSelph or others, or where suspension or termination is otherwise reasonably necessary to protect the Site or its users. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, indemnification, dispute resolution, and other accrued rights or obligations.
20. Governing Law
To the maximum extent permitted by law, these Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Subject to the Arbitration section above, any dispute not subject to arbitration, and any action to compel arbitration or confirm, modify, or vacate an arbitration award, will be brought in a court of competent jurisdiction in California, except where applicable consumer law requires otherwise.
21. International Users
The Site is controlled and operated from the United States. If you access the Site from outside the United States, you are responsible for complying with laws that apply to you. NextSelph does not represent that the Site is appropriate or available in every jurisdiction.
22. Changes to the Site or Terms
We may modify the Site and these Terms from time to time. When we make material changes to these Terms, we will post the updated Terms and revise the effective date. Where required by law, we will provide additional notice or obtain consent. Your continued use of the Site after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.
23. General Terms
If any provision of these Terms is found unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect. These Terms, together with the Privacy Policy and any additional terms presented for a specific feature, constitute the entire agreement between you and NextSelph concerning the Site. No joint venture, partnership, employment, fiduciary, or agency relationship is created by your use of the Site.
